[Part 5] Brief Rebuttal Against Hasan Hasan-[The Mainstream, ISIS Implementation of Shariah And Shariah Brute Justice]

Hasan Hasan said:

“Indeed, one of the fascinating insights we found is that Isis presents the “mainstream” Islam practised by Muslims today as one that was “invented” over the past few decades. To unravel this so-called invented Islam, Isis deliberately digs deep into Islamic sharia and history to find arcane teaching and then magnify it. It does so to shock its potential recruits and demonstrate it is preaching a pure and true Islam obscured by the mainstream. Take, for example, the group’s punishment for individuals accused of homosexuality. In a series of incidents in recent weeks, Isis has thrown individuals accused of being gay from the highest buildings. This method as a sharia punishment is unheard of, even in countries where sharia brute justice is openly practised, such as Saudi Arabia”.[End of quote]

Observation And Comment On Hasan Hasan’s Above Statement

This above statement of Hasan Hasan is a well-planned deception as well as a mixture of truth and falsehood. Indeed, this style of writing is one of the satanic strategies of the militant secularists, the misguided modernists, the opinionated pseudo researchers and self-appointed commentators on Islaam and sects. As for the scholars of Islaam and the certified students of knowledge of the Sharee’ah, they fear their Lord in every word they utter – neither propagate ISIS’s extremism nor the negligence and planned deceptions of pseudo researchers like Hasan Hasan.

Firstly, regarding Hasan Hasan’s statement: “Indeed, one of the fascinating insights we found is that Isis presents the “mainstream” Islam practised by Muslims today as one that was “invented” over the past few decades”.

This statement is a well-planned deception because the reader is left with the impression that the problem is only between ISIS and mainstream Muslims, but rather the problem is extremism and negligence – the extremism propagated by the devils of ISIS and the negligence and distortion championed by Hasan Hasan and other deceitful writers. As for Hasan Hasan’s statement, “Islam practiced by Muslims today”, this statement requires detail and distinction so that the poison hidden in it by Hasan Hasan is removed, because indeed whilst refuting Jihaadists and considered them to outside the confines of mainstream Islaam, he also made an attempt to bring them into the fold of Salafiyyah, even though Salafiyyah is free from this mighty false accusation. Indeed, Islaam practiced in the past, today or in future must be in agreement with three sources: The Qur’aan, the authentic Sunnah and the understanding of the Sahaabah – free from ISIS’s extremism, Hasan Hasan’s false accusations against Salafiyyah, the religious innovations of the Shiites and the soofees, and all other deviated sects.  Al-Allaamah Abdul Muhsin al-Abbaad [hafidhahullaah] said:

The noble Messenger (sallal-laahu-alayhi-wasallam) stated that deeds are rejected if they are based on bidah: [مَنْ أَحْدَثَ فِي أَمْرِنَا هَذَا مَا لَيْسَ مِنْهُ فَهُوَ رَدٌ – He who innovates something in this matter of ours (i.e. Islam) that is not of it will have it rejected (by Allah)].

And in another wording of this hadeeth in Saheeh Muslim the Prophet said:[مَنْ عَمِلَ عَمَلًا لَيْسَ عَلَيْهِ أَمْرُنَا فَهُوَ رَد  – He who does an act (of worship) which we have not commanded (i.e. not commanded by the Prophet), will have it rejected].

And the noble Messenger [sallal laahu alayhi wasallam] also said:

فَإِنَّهُ مَنْ يَعِشْ مِنْكُمْ فَسَيَرَى اخْتِلَافًا كَثِيرًا، فَعَلَيْكُمْ بِسُنَّتِي وَسُنَّةِ الْخُلَفَاءِ الرَّاشِدِينَ الْمَهْدِيينَ، عَضُّوا عَلَيْهَا بِالنَّوَاجِذِ، وَإِيَّاكُمْ وَمُحْدَثَاتِ الْأُمُورِ؛ فَإِنَّ كُلَّ بِدْعَةٍ ضَلَالَةٌ

Verily he lives long among you will see a lot of differing, so you must keep to my Sunnah and to the Sunnah of the Khulafaa ar-Rashideen (the rightly guided caliphs). Adhere to it with your molar teeth (i.e. adhere to it firmly). And beware of newly invented matters [in the religion], for every newly invented matter [in the religion] is a bidah (innovation in the religion), and every bidah is misguidance.” [Abu Dawood. Number 4607] [Tirmidhee. Number 2676]

(Also) the Messenger (sallal-laahu-alayhi-wasallam) has clarified in the hadeeth about the seventy three sects amongst whom seventy-two sects will enter the hell fire and one sect will be saved.  He clarified that this saved sect are those who adhere to the path him and his noble companions adhered to.

Imaam Maalik [rahimahullaah] said: “The latter part of this Ummah (i.e. those who will come after the Salaf) will not be rectified except by way of that which rectified it’s earlier part (i.e. the Salaf).’’ And he [rahimahullaah) said: ‘’Whoever innovates a bidah in Islaam and considers it to be something good, then indeed he has claimed that Muhammad betrayed the Risaalah (i.e. the message he was entrusted with); because Allaah said: ٱلۡيَوۡمَ أَكۡمَلۡتُ لَكُمۡ دِينَكُمۡ -This day, I have perfected your religion for you.” Therefore, what was not part of the religion at that time (i.e. during the time of the Messenger) cannot be part of the religion today (i.e. after his departure from this world).”

Al-Allaamah Abdul Muhsin Al-Abbaad [hafidahullaah] said: It is not enough for a person to say: “I am going to do this act of worship even though it was not (performed by) the Prophet because my intention is pure and good.” The evidence (against this statement) is that when it reached the Messenger (sallal-laahu-alayhi-wasallam) that a man amongst his noble companions slaughtered the Eed sacrifice before the Eed Salaah, he (sallal-laahu-alayhi-wasallam) said to him: شَاتُكَ شَاةُ لَحْمٍ- “Your (slaughtered sheep was just mutton (not a sacrifice).” [Saheeh Bukhaari. Number: 5556]; meaning: It is not considered Eed sacrifice because it was not carried out in conformity with my Sunnah. Therefore, what is in conformity with the Sunnah is that the Eed sacrifice is done after the Eed Salaah; but as for sacrificing before the Salaah, then indeed it is outside its specified time and will not be regarded as (Eed sacrifice).

Al-Haafidh said in Fat-hul Baaree (10/17): “Shaikh Abu Muhammad Bin Abu Hamzah said: In this hadeeth is (established the fact that) if an action (i.e. an act of worship) is done with a sincere intention, it is still not (considered) righteous unless it is in conformity with the legislated divine revelation.

Also that which will shed more light on this affair is when Abdullaah Ibn Mas’ood came to a people who had gathered in the Masjid, and each of them had a number of stones/pebbles; and there was one man amongst them saying: ‘Say ‘Subhaanallaah’ a hundred times; say ‘Laa-ilaaha Ilal laah’ a hundred times; say ‘Allaahu Akbar’ a hundred times. So they repeated.

Then Abdullaah Ibn Mas’ood approached them and said: “What is this that you are doing?” They said: “O Abu Abdurrahman! These are pebbles to count the number of times we say Allahu Akbar, Laa ilaaha Illal laah and Subhaanallaah.” He said: “Count your sins and I assure you that you are not going to lose anything of your hasanaat. O Ummah of Muhammad, how quick is your destruction! These are the Companions of your Prophet present in great numbers; these are his clothes not worn out yet, and his pots are not broken yet. I swear by the One (i.e. Allaah) in Whose Hands my soul is, either you are following a religion that is better than the Religion of Muhammad or you are opening a door of misguidance.” They said: “O Abu Abdurrahman! We swear by Allaaah that we intend nothing other than good.’’ He said: How many people want good but never reach it! [Sunan Ad-Daarimee 1/68-69] [Also recorded by Imaam Albaanee in As-silsilah As-Saheehah. Number 2005] [Ref 1]

Therefore, we remind Hasan Hasan of the fact that any idea or view brought into Islaam- whether by ISIS or any other group, then indeed it is rejected if it opposes the Qur’aan, the authentic Sunnah and the understanding of the Sahaabah. The statement “mainstream Islam practised by Muslims today” must be understood in this context mentioned above from the ahadeeth and statements of the scholars, but obviously neither are pseudo researchers able to make a distinction between truth and falsehood in these affairs nor are those who publish their ambiguities to the mases honest enough to allow them to do so.

Shaikhul Islaam [rahimahullaah] said:

And when it is case that the true followers of the Prophets [peace and blessings of Allaah be upon them] are people of knowledge and justice, therefore the speech of the people of Islaam and the true adherents to the Prophetic Sunnah regarding the unbelievers and the proponents of religious innovations has to be based on knowledge and justice, and not conjecture and what the soul desires. And due to this the Prophet [peace and blessings of Allaah be upon him] said: “The judges are three: one will go to Paradise and two to Hell. A man who knows the truth and judges with it will enter paradise; a man who knows the truth but judges with the opposite of it will enter the fire, and a man who judges for the people based on ignorance will enter the fire’’. [Reported by Imaam Abu Dawud 3573] And when it is the case that the one who judges between the people in [affairs] of wealth, blood [i.e. murder cases, physical violence etc] and honour will enter the hell fire if he is not a just scholar, then how about the one who passes judgements – without knowledge and justice – on creeds, religions, the fundamentals of belief,  divine knowledge and the general fundamental principles related to different subject matters, as is the case with ahlul bidah wal ahwaa [the proponents of religious innovations and desires]- those who follow the ambiguous doubtful matters, abandon those explicitly clear texts that have been transmitted by the Prophets [peace and blessings of Allaah be upon them], cling to affairs that share an ambiguous similarity through mere analogy and opinions,  and then present affairs whose differences can neither be reconciled nor equated, just as is the case with the unbelievers and all the proponents of religious innovation and followers of desires, who liken the creation to the Creator [i.e. they give the creation the Perfect Attributes that only belong to the Creator], and liken the Creator to the creation [i.e. by describing the Creator with the imperfect attributes of the Creation], and then they put forward an evil similitude for Allaah by way of thoughtless and confusing speech. This is because the false religion of the Christians is an innovated [or concocted] religion- innovated after the departure of the Messiah [peace and blessings of Allaah be upon him] and altered the religion of the Messiah through it; so they deviated from the Messiah’s [peace and blessings of Allaah be upon him] path and remained upon that which they innovated. [Ref 2]

As for ISIS accusing Muslims of inventing a new Islaam, then indeed people who live in glass houses should not throw stones, because the khawaarij are one of the most evil sects in this Ummah and their affair is well-known in the authentic Sunnah.

The Messenger [sallal laahu alayhi wasallam] said,

“A people will come from the east who recite the Qur’aan, but it will not go beyond their throats. They will pass through the religion just as an arrow pierces its target and they will not return to it just as the arrow does not return to the bow”.

[Al-Bukhaari 7123]

The Messenger [sallal laahu alayhi wasallam] said

“During the last days [i.e. end of time], there will be young people with foolish dreams. They will say the best of statements amongst creation, but they will pass through Islam just as an arrow passes through its game. Their Eemaan will not go beyond their throats”.

[Al-Bukhari 4770]

The Messenger [sallal laahu alayhi wasallam] said:

“There will be discord and division in my Ummah and a people will come with beautiful statements but evil deeds. They recite the Qur’aan, but it will not go beyond their throats. They will exit the religion just as an arrow leaves its target and they will not return until the arrows returns to its notch. They are the worst of the creation”.

[Abu Dawud 4765]

The Messenger [sallal laahu alayhi wasallam] said:

“Some people from my Ummah will emerge from the east, who recite the Quran but it will not go beyond their throats. Every time a group of them appears it will be cut off. The Messenger repeated this and on the tenth time he said, “Every time a group of them emerges, it will be cut off, until Dajjaaj appears from their remnants”.

[Musnad Aḥmad 27767]

Ubaydullaah Ibn Abee Raafi said, “The Khawaarij came out against Ali ibn Abee Taalib [radiyallaahu0-anhu] and said, ‘There is no judgement, except the judgement of Allaah’, so Ali said them, ‘A statement of truth by way of which falsehood is intended’”.

[Ṣaḥeeh Muslim 1066]

 

And regarding Hasan statement, “To unravel this so-called invented Islam, Isis deliberately digs deep into Islamic sharia and history to find arcane teaching and then magnify it. It does so to shock its potential recruits and demonstrate it is preaching a pure and true Islam obscured by the mainstream”.  [End of quote]

Firstly, with regards to the khawaarij of ISIS and their so called Islamic State, then indeed let us look at the deeds of their predecessors! Shaikh Abdur-Razzaaq Al-Badr [hafidha-hullaah] was asked whether the sects that existed in the past such as the Mutizilah, Jahmiyyah and others are present today; so he said, “The scholars state in their books about the sects: [لِكُلِّ قَوْمٍ وَارِث وَلِكُلِّ أَرْضٍ حَارِث وَلِكُلِّ ضَرٍّ هَالِك -Every people have their inheritors, every earth has a cultivator and every evil has one destroyed by it.” This is enough an answer [i.e. the contemporary sects are from the ancient ones]”. [Ref 6]

So, with regards to the deeds of the Khawaarij of today [ISIS, Al-Qaida, Jabhat An-Nusra and their ilk], let us ponder upon three observations of the scholars – Imaam Wahb Ibn Munabbih, Imaam Ibn Katheer and Imaam At-Tabari [rahimahumullaah] – regarding the behaviour of their predecessors!

Imaam Wahb Ibn Munabbih [rahimahullaah] said:

I was acquainted with the early period of Islaam. By Allaah, the Khaawaarij have never had a group except that Allaah caused it to split because of their evil state of affairs. Never did one of them publicize his opinion except that Allah caused his neck to be struck. Never did the Muslim Ummah unite behind a man from the Khawaarij. If Allah allowed the opinion of the Khawaarij to be accepted and established, then the earth would have been corrupted, the carriageways would have been cut off, Hajj to the sacred house of Allah would have ceased and the affair of Islam would have reverted to ignorance until the people seek shelter in the mountains as they did in the time of ignorance. If ten or twenty men among them were to rise, there would not be a man among them except that he claims the khilaafah for himself- every man among them would have ten thousand other men with him and all of them fighting each other, accusing one another of disbelief until the believer fears for himself, his religion, his life, his family, his wealth, and would not know where to travel or who to be with. [Ref 3]

Imaam Ibn Katheer [rahimahullaah] said:

“If they ever gained strength, they would surely corrupt the whole of the earth, Iraq and Syria (Shaam) – they would not leave a baby, male or female, neither a man or a woman, because as far as they are concerned the people have caused corruption, a corruption that cannot be rectified except by mass killing”. Imaam At-Tabariy [rahimahullaah] said:

“The Khawarij came to a village and captured a man and his daughter. She said to them, ‘O people of Islaam! Verily, my father is an old man so do not kill him, and I am only a girl. By Allaah, I have never committed immorality and I have never harmed anyone’. They brought her out to murder her whilst she kept on saying, ‘What sin have I committed; what sin have I committed?’ She fainted thereafter and they killed her with their swords”. [Ref 5]

Indeed, we have all witnessed the atrocities perpetrated by the present day Khawaarij, just as the above mentioned three Imaams of the Sunnah reported incidents regarding ISIS’s barbaric predecessors; rather the khawaarij do not even spare one another, as Imaam Wahb Ibn Munabbih [rahimahullaah] stated, “If ten or twenty men among them were to rise, there would not be a man among them except that he claims the Caliphate for himself; every man among them would have ten thousand other men with him and all of them fighting each other, accusing one another of disbelief”. And regarding Hasan Hasan’s statement, “Take, for example, the group’s punishment for individuals accused of homosexuality. In a series of incidents in recent weeks, Isis has thrown individuals accused of being gay from the highest buildings. This method as a sharia punishment is unheard of, even in countries where sharia brute justice is openly practised, such as Saudi Arabia”.

Firstly, with regards to homosexuality, the Muslim has no doubt that it is a major sin. Shaikh Abdul Waahid Abu Khadeejah [hafidhahullaah] stated: The traditional Muslim viewpoint based on Religious sources:

Quote: Muslim scholars throughout history have taken this story [i.e. Sodom and Gomorrah] to mean that Allah has prohibited homosexuality absolutely, i.e. courtship and sexual relationships between men. Muslims see homosexuality as an unnatural condition, an immoral inclination, even a mental illness which is dangerous for the individual and society in terms of its goodness and morality. Islam teaches that a Muslim cannot be pious and obedient to God and be a practising homosexual; the two states are incompatible. However, Muslim doctrine does not remove from the fold of Islam the one who practices the major sin of homosexuality.

Quote: The Qur’an does not say how homosexuality should be punished, but a saying of the Prophet (may peace and blessings be upon him) makes clear: “Whoever you find engaging in the action of the people of Lūt, execute the one who does it, and the one to whom it is done.” (Ibn Majah 2561, Tirmidhi 1456) This saying must not be used by individuals as an excuse to enact or incite violence against homosexuals.

Quote: Prescribed punishments can only be carried out by the legal authority in a country that practices Islamic Law (i.e. in a Muslim country); and there must be clear evidence that actual sex had taken place. The Muslim penal code carries out punishments  on the basis of the unlawful act that is committed and not on the basis of a persons’ inclinations where no illegal act has been committed.

And regarding Hasan Hasan’s statement, “This method as a sharia punishment is unheard of, even in countries where sharia brute justice is openly practised, such as Saudi Arabia”.

We say to Hasan Hasan: It is enough that homosexuality is a major sin, but the sin does not exit a person from the fold of Islaam. Also – as Shaikh Abdul Waahid stated, “The Qur’an does not say how homosexuality should be punished” as well as the fact that only the state authorities can carry out the punishment. As for the Khawaarij – ISIS, Al- Qaida and their ilk, they will never be fit for authority.

As for Hasan Hasan’s statement, “Even in countries where sharia brute justice is openly practised, such as Saudi Arabia”, we say to him and his devil as follows:

Allaah [The Most High] said:

يَا أَيُّهَا الَّذِينَ آمَنُوا اسْتَجِيبُوا لِلَّهِ وَلِلرَّسُولِ إِذَا دَعَاكُمْ لِمَا يُحْيِيكُمْ ۖ وَاعْلَمُوا أَنَّ اللَّهَ يَحُولُ بَيْنَ الْمَرْءِ وَقَلْبِهِ وَأَنَّهُ إِلَيْهِ تُحْشَرُونَ

O you who believe! Answer Allaah (by obeying Him) and (His) Messenger when he calls you to that which will give you life, and know that Allaah comes in between a person and his heart (i.e. He prevents an evil person to decide anything). And verily to Him you shall (all) be gathered. [8:24]

Imaam Ibnul Qayyim [rahimahullaah] said:

This Aayah comprises of some affairs: One of them is that a beneficial life is only attained through obedience to Allaah and His Messenger; so whoever does not submit to this call [of Allaah and His Messenger] will have no life [i.e. a rightly guided heart], even though he has life similar to that of the most despicable animals [i.e. only follows desires etc].

Therefore, real and good life is the life of that one who answers the call of Allaah and His Messenger- outwardly and inwardly. They are those who are alive [with Eemaan in this life], or even if they have passed away [i.e. died but their good deeds remain and others follow them]. As for others besides them, they are dead [i.e. heedless hearts], even if their bodies are alive.

And this is why the one with the most perfect life amongst the people is the one with the most perfect response to the call of the Messenger [sallal-laahu-alayhi-wasallam] because there is life in everything he calls to [i.e. upright guidance]; therefore, whoever missed a portion of it, he will miss a portion of life [i.e. upright guidance] and there is life [i.e. upright guidance for the person] in accordance with his response to the (call) of the Messenger [sallal-laahu-alayhi-wasallam].

Mujaahid [rahimahullaah] stated [regarding the statement of Allaah]: [لِمَا يُحْيِيكُمْ -To that which will give you life] – meaning, the truth.

Qataadah [rahimahullaah] stated [regarding the statement of Allaah]: [لِمَا يُحْيِيكُمْ -To that which will give you life]- meaning, this Qur’aan in which is life [i.e. upright guidance], safety and protection in the life of this world and the hereafter.

As-Sadee [rahimahullaah] stated [regarding the statement of Allaah]: [لِمَا يُحْيِيكُمْ -To that which will give you life]- meaning, Islaam, and they were given life [i.e. upright guidance] by way of it after been dead [i.e. completely misguided] by way of disbelief.

And regarding the statement of Allaah: [وَاعْلَمُوا أَنَّ اللَّهَ يَحُولُ بَيْنَ الْمَرْءِ وَقَلْبِهِ وَأَنَّهُ إِلَيْهِ تُحْشَرُونَ – And know that Allaah comes in between a person and his heart (i.e. He prevents an evil person to decide anything). And verily to Him you shall (all) be gathered].

The First Explanation Regarding This Above Aayah: It is well known that Allaah is the one who intervenes between the believer and disbelief, and between the disbeliever and Eemaan, between the people of obedience and their disobedience to Him, and between the people of disobedience and their obedience to Him.  This is the saying of Ibn Abbaas and that of the majority of the Mufassiroon.

The Second Explanation is that Allaah is close to the heart of the human [by His knowledge] and no secret is hidden from Him.  This was mentioned by Al-Waahidiy from Qataadah. And it appears that this statement [reported from Qataadah] is more in conformity with the context [of the Ayah (i.e. ‘And know that Allaah comes in between a person and his heart]; because the basis of this Istijaabah [i.e. responding to the call of Allaah and His Messenger] is by way of the heart.  A bodily response is of no benefit without the response of the heart; because Allaah comes between a person and his heart and knows whether the person has responded to Him with his heart or hides the opposite of that.

And concerning the first saying [i.e. the saying of Ibn Abbaas and the majority of the Mufassiroon], it is with regards to the fact that if you turn away from [responding to the call of Allaah and His Messenger], you will not be safe and thus Allaah comes between you and your hearts as a punishment for abandoning [this response] after the truth had been explained and made clear.  So, you will be like what (has been mentioned) in the statement of Allaah: [ وَنُقَلِّبُ أَفْئِدَتَهُمْ وَأَبْصَارَهُمْ كَمَا لَمْ يُؤْمِنُوا بِهِ أَوَّلَ مَرَّةٍ – And We shall turn their hearts and their eyes away (from guidance), as they refused to believe therein for the first time]. [6:110]

And Allaah said: [فَلَمَّا زَاغُوا أَزَاغَ اللَّهُ قُلُوبَهُمْ – So when they turned away (from the Path of Allaah), Allaah turned their hearts away (from the Right Path)].[61:5] And Allaah said: [فَمَا كَانُوا لِيُؤْمِنُوا بِمَا كَذَّبُوا مِنْ قَبْلُ  – But they were not such as to believe in that which they had rejected before].[7:101] This ayah is a warning against [failing to respond] with the heart even if response had been made by way of the limbs. [Ref 7]

Allaah [The Exalted] said:

فَلۡيَحۡذَرِ ٱلَّذِينَ يُخَالِفُونَ عَنۡ أَمۡرِهِۦۤ أَن تُصِيبَہُمۡ فِتۡنَةٌ أَوۡ يُصِيبَہُمۡ عَذَابٌ أَلِيمٌ

And let those who oppose the Messenger’s [Muhammad] commandment [i.e. his Sunnah legal ways, orders, acts of worship, statements, etc.] [among the sects] beware, lest some Fitnah befall them or a painful torment be inflicted on them. [Surah An-Noor. Aayah 63]

Imaam Ahmad [rahimahullaah] said about this Ayah [i.e. Surah An-Noor. Aayah 63]: Do you know what Al-Fitnah is? Al-Fitnah is Shirk. Perhaps if he [i.e. the person] rejects some of his [i.e. the Prophet’s] statements, then something of deviation enters his heart, so he is destroyed. [Ref 8]

Narrated Abu Musa (radiyallaahu-anhu): The Prophet (sallal-laahu-alayhi-wasallam) said, ‘’My example, and the example of what I have been sent with is that of a man who came to some people and said, O people! I have seen the enemy’s army with my own eyes and I am a plain warner; so protect yourselves!’ Then a group of his people obeyed him and fled at night proceeding stealthily till they were safe, while another group of them disbelieved him and stayed at their places till morning when the army came upon them and killed and ruined them completely. So this is the example of that person who obeys me and follows that truth which I have brought (the Qur’aan and the Sunnah), and the example of the one who disobeys me and disbelieves the Truth I have brought. [Ref 9]

Allaah [The Exalted] said:

 فَلَا وَرَبِّكَ لَا يُؤۡمِنُونَ حَتَّىٰ يُحَكِّمُوكَ فِيمَا شَجَرَ بَيۡنَهُمۡ ثُمَّ لَا يَجِدُواْ فِىٓ أَنفُسِہِمۡ حَرَجً۬ا مِّمَّا قَضَيۡتَ وَيُسَلِّمُواْ تَسۡلِيمً۬ا

But no, by your Lord, they can have no Faith, until they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission. [Surah An-Nisaa. Aayah 65]

Allaah [The Exalted] said:

وَمَا كَانَ لِمُؤۡمِنٍ۬ وَلَا مُؤۡمِنَةٍ إِذَا قَضَى ٱللَّهُ وَرَسُولُهُ ۥۤ أَمۡرًا أَن يَكُونَ لَهُمُ ٱلۡخِيَرَةُ مِنۡ أَمۡرِهِمۡۗ وَمَن يَعۡصِ ٱللَّهَ وَرَسُولَهُ ۥ فَقَدۡ ضَلَّ ضَلَـٰلاً۬ مُّبِينً۬ا

It is not for a believer, man or woman, when Allah and His Messenger have decreed a matter that they should have any option in their decision. And whoever disobeys Allah and His Messenger, he has indeed strayed in a plain error. [Surah al-Ahzaab. Aayah 36]

Imaam Ash’Shaatibee [rahimahullaah] said:

Know that Allaah has established this Sharee’ah as a proof against the creation [i.e. mankind and jinn] – the old and young alike, the obedient and the disobedient, the righteous and the wicked. Allaah did not specify the proof against anyone in exclusion of another one. Also all the other revealed laws were established as proof against all the other nations to whom they were revealed. The Sharee’ah is the judge- restrictedly and unrestrictedly, and the (source of judgement) and the judge on all those who have reached the age of responsibility.

It is the path based on (what Allaah has ordained) and the greatest Guide. And have you not seen the statement of Allaah: [وَكَذَٲلِكَ أَوۡحَيۡنَآ إِلَيۡكَ رُوحً۬ا مِّنۡ أَمۡرِنَا‌ۚ مَا كُنتَ تَدۡرِى مَا ٱلۡكِتَـٰبُ وَلَا ٱلۡإِيمَـٰنُ وَلَـٰكِن جَعَلۡنَـٰهُ نُورً۬ا نَّہۡدِى بِهِۦ مَن نَّشَآءُ مِنۡ عِبَادِنَا‌ۚ وَإِنَّكَ لَتَہۡدِىٓ إِلَىٰ صِرَٲطٍ۬ مُّسۡتَقِيمٍ۬ – And thus We have sent to you (O Muhammad) Ruhan (an Inspiration, and a Mercy) of Our Command. You knew not what is the Book, nor what is Faith? But We have made it (this Qur’an) a light wherewith We guide whosoever of Our slaves We will. And verily, you (O Muhammad) are indeed guiding (mankind) to the Straight Path (i.e. Allah’s religion of Islamic Monotheism)].’’ [Soorah Ash-Shooraa. Ayah: 52]

He [alayhis salaatu wassalaam] was the first to be guided to the Book and Eemaan, and then those who followed him. The Book is the Guide and also the Sunnah which was sent down upon him explains that guidance [i.e. the Sunnah and the Qur’aan explain each other]. All the creation [i.e. mankind and Jinn] are guided by it; therefore, when this is the case, the Sharee’ah is worthy of being a decisive proof against them [i.e. against mankind and Jinn] and a beacon by way of which they are guided to the truth. Their nobility is established in accordance with how far they embrace its rulings- through acting upon them in speech, belief and deeds and not merely due to the level of their intellects or their nobility amongst their people. That is because Allaah [The Most High] has determined nobility through Taqwa and not other than it. Allaah [The Most High] said: [إِنَّ أَڪۡرَمَكُمۡ عِندَ ٱللَّهِ أَتۡقَٮٰكُمۡ‌ۚ- Verily, the most honourable of you with Allah is that (believer) who has At-Taqwa] [49:13]

The one who is the firmest in adherence to the Sharee’ah is more worthy of honour and nobility, but it is not possible for the one below this (i.e. the one whose adherence to the Sharee’ah is below that of the one who is firmest in adhering to it) to reach the highest level of honour based on his adherence to the Sharee’ah. Therefore, honour is (measured) in accordance with one’s (adherence) to the Sharee’ah. [Ref 10]

Shaikh Abdul Waahid Ar–Rai [ Abu Khadeejah (may Allaah) preserve him)] stated:

“The goal of a Muslim in his or her life is to please Allah by worshipping Him alone and, by doing so, he enters Paradise after death. A Muslim attains the pleasure of Allah and His Paradise through living an “ethical” life by: Sincere religious observances upon the Prophet’s way: Shahādah (the testimony of faith), Salāh (daily prayers), Zakāh (charity), Sawm (fasting), Hajj (the pilgrimage), and other obligations such as: Umrah, the Friday prayer, etc. Leading a righteous life by keeping away from that which Allah has forbidden, and being a morally upright person: generous, kind, modest, merciful, humble, sincere, etc”.

“Many Islamic countries are ruled by Muslims in line with their faith and the teaching of the Qur’an and Hadeeth. They can hear the call to prayer, they are not allowed to cohabit with the opposite sex, and must marry if they want to start a family, they cannot drink alcohol, gamble and so on. So those laws help Muslims live a more Islamic life. Offences such as rape, paedophilia and murder carry severe punishments because they are: (a) destructive crimes, (b) go against Islamic teachings, (c) ruin the fabric of civil society”.

“The British government is a secular government (i.e. not based on religion). It allows practices that Muslims are not allowed to indulge in, such as drinking alcohol, eating pork, partaking in interest transactions, having sexual relations before marriage. However Muslims do not have to partake in practices that go against their faith. There were many practices that took place in Makkah when the Prophet (peace be upon him) lived there for the first thirteen years of his Prophethood, the worst of those being idolatry. Other oppositions to Islam also took place (such as the killing of baby girls), but he persevered patiently with the people and did not abandon calling them to worship Allah alone and to good conduct and morals. Shaikh Abdul Waahid Ar-Rai [Abu Khadeejah (may Allaah preserve him)] also stated: “Sharī’ah in the language means “a path to a watering hole”. In Islamic usage, it means: The Islamic Religious Law revealed by Allāh (Almighty God) which governs all the affairs of society for the benefit of the people. It governs areas such as business, banking, contracts, family, marriage, divorce, security, criminal law and many other affairs pertaining to society. Although Muslims in Britain are subject to British law and the British legal system, Sharī’ah tribunals are allowed in certain areas as an alternative way of resolving disputes. These are aimed at resolving commercial, civil and matrimonial disputes to the satisfaction of both sides. Sharī’ah Law is based upon the Qur’ān and Sunnah, and judgements are made in accordance to these two sources. Only those well-versed with the Religion and jurisprudence (rulings in law) are permitted to judge in Sharī’ah matters”.

Allaah [The Exalted] said:

يَـٰٓأَيُّہَا ٱلَّذِينَ ءَامَنُواْ كُتِبَ عَلَيۡكُمُ ٱلۡقِصَاصُ فِى ٱلۡقَتۡلَى‌ۖ ٱلۡحُرُّ بِٱلۡحُرِّ وَٱلۡعَبۡدُ بِٱلۡعَبۡدِ وَٱلۡأُنثَىٰ بِٱلۡأُنثَىٰ‌ۚ فَمَنۡ عُفِىَ لَهُ ۥ مِنۡ أَخِيهِ شَىۡءٌ۬ فَٱتِّبَاعُۢ بِٱلۡمَعۡرُوفِ وَأَدَآءٌ إِلَيۡهِ بِإِحۡسَـٰنٍ۬‌ۗ ذَٲلِكَ تَخۡفِيفٌ۬ مِّن رَّبِّكُمۡ وَرَحۡمَةٌ۬‌ۗ فَمَنِ ٱعۡتَدَىٰ بَعۡدَ ذَٲلِكَ فَلَهُ ۥ عَذَابٌ أَلِيمٌ۬

وَلَكُمۡ فِى ٱلۡقِصَاصِ حَيَوٰةٌ۬ يَـٰٓأُوْلِى ٱلۡأَلۡبَـٰبِ لَعَلَّڪُمۡ تَتَّقُونَ

O you who believe! Al-Qisas (the Law of Equality in punishment) is prescribed for you in case of murder: the free for the free, the slave for the slave, and the female for the female. But if the killer is forgiven by the brother (or the relatives, etc.) of the killed against blood money, then adhering to it with fairness and payment of the blood money, to the heir should be made in fairness. This is an alleviation and a mercy from your Lord. So after this whoever transgresses the limits (i.e. kills the killer after taking the blood money), he shall have a painful torment. And there is (a saving of) life for you in Al-Qisas (the Law of Equality in punishment), O men of understanding, that you may become pious. [Surah Al-Baqarah. Aayaat 178-179]

Ash-Shaybaan [rahimahullaah] reported from Qataadah [rahimahullaah] who said, “Amongst the people of the pre-Islamic era, there were those who used to transgress and follow shaytaan. If a person had a great number of supporters and strength, and then a slave of theirs is murdered by a slave of another people, then out of wanting to show their superior strength, they would say, ‘We shall not kill (by way of revenge) except a free person amongst them’. And if a woman kills another woman from another tribe, they said, ‘We shall not  kill (by way of revenge) except a man amongst them”. So, Allaah revealed this Aayah.

And regarding the statement: [وَلَكُمۡ فِى ٱلۡقِصَاصِ حَيَوٰةٌ۬ يَـٰٓأُوْلِى ٱلۡأَلۡبَـٰبِ لَعَلَّڪُمۡ تَتَّقُونَ – And there is (a saving of) life for you in Al-Qisas (the Law of Equality in punishment), O men of understanding, that you may become pious], Az-Zujaaj [rahmahullaah] said, “If a man knows that he will be killed if he murders someone, then he will refrain from murder, so by way of this both the lives of others and his are preserved. [Ref 11]

Imaam Ibnul Qayyim [rahimahullaah] said, “He refrains from killing someone else out of loving and giving precedence to his life, so in this is a preservation of his life and that of the one he wants to kill. Also when a man killed another man from a family and a tribe, the family or tribe of the victim would kill everyone they can find from the family, tribe and city district of the murderer, and in this there was overwhelming corruption and destruction; so Allaah legislated the law of equality in punishment so that none else is killed except the one who committed murder. Therefore, this preserved the lives of murderer’s relatives and the people of his city. [Ref 12]

Imaam As-Sadi [rahimahullaah] said, “By way of it [i.e. the law of equity in punishment] life is preserved and the misguided ones who exit the confines of justice are restrained. The one who knows that he will be killed if he kills, then he may not attempt to kill. And when others witness a murderer being executed [i.e. by the government], they will take heed and refrain from the crime of murder. So, if the punishment against a murderer was other than killing him [by way of capital punishment], the evil act of murder would not have been prevented. This is the case regarding all the prescribed punishments of the Sharee’ah, because they contain means of prevention of that which shows the perfect Wisdom of The All-Wise , the Oft-Forgiving.

And Allaah specified the mention of life in this Aayah as emphasis and exalting it. And when it is the case that none knows the reality of this ruling except the people of sound intellect and strong understanding, Allaah addressed them specifically. [Ref 13]

Therefore, we say to Hasan, the believer is happy to be judged by the Sharee’ah. If the legitimate rulers – and not the barbarians of ISIS – in the sight of Allaah establish the Sharee’ah – whether in Saudi or elsewhere, the believer is pleased with it. And when the rulers fall short- just as we ourselves fall short, we neither rebel nor incite others to rebel against them. And we leave you with the statement of al-Allaamah Saaleh al-Fawzaan [hafidhahullaah] – regarding the enemies of Saudi – when he stated: O slaves of Allaah! Be grateful for the blessings of Islaam. You know- may Allaah protect you- that this country is established upon the creed of pure Islamic monotheism, sincerity in worshipping Allaah alone, enjoining good, forbidding evil, ruling by the share-ah and establishment of the prescribed punishments ordained by Allaah; so its state of security remains and stability continues, and it lives—as you know-in blessing, comfort, security and stability, whereas the other countries are in trials and confusion.

This country-and all praise be to Allaah-is in a state of security, stability, comfortable living and tranquillity, but this stability is not pleasing to the enemies of this country. So they have not ceased in attempting to demolish its state of security. They attempt to do this, so that it becomes like other countries.

It [i.e. Saudi Arabia] occupies the center of the hearts of the Muslims. It is the Qiblah in their Salaah and it has a status in the Islamic world. So if it were to be destabilised—just as the enemies desire to destabilisee the entire Islamic world—then who will establish the Hajj and Umrah; who will provide safety for the pilgrims whilst they seek to fulfil the rites of Hajj and Umrah, except this country with the Help of Allaah [Glorified and Exalted Be He].

The [social] structure of this country will be destabilised if its security is lost, then where will the Islamic world proceed to? And because of this, the enemies of Islaam plot against this country day and night-as you all know sometimes through seeking to cause doubts about the creed and disseminating filthy views amongst the children of the Muslims in order to implant idleness, extremism, or taking up arms, or carrying explosives, or causing destruction; sometimes by way of corrupting the manners, disseminating forbidden affairs and forbidden desires amongst the Muslim youth, in order to corrupt their manners and deprive them of their religion with the claim of freedom of expression and other false statements. Allaah has freed mankind from idol worship, forbidden desires and despicable manners. This is the correct freedom, but as for what is in opposition to it, such as evil desires, doubts and corrupt manners, this is the freedom of animals. However, they want this in order to corrupt the Muslim youth-either through extremism and harshness or through laxity in their religion. They attempt this and that-either to corrupt the intellects of the Muslim youth with intoxicants, drugs, cigarettes, Qaat and other drugs and intoxicants or through fabrications [i.e. false ideas, views etc]. They want to do away with the Muslim youth because after Allaah’s [Glorified Be He] Support for the Muslim society, the society is built upon its youth, therefore they want to corrupt the Muslim youth through any means so that they are able to demolish this country. As you can see –from time to time–huge quantities of opium and other types of drugs are smuggled. As you can see this did not come from nothing; rather it came about as an evil plan against this country. They want to destroy it from every direction. Therefore, you should all be a singular hand with your rulers and those placed in charge over your affairs to repel this enmity and pay attention to it. [Ref 14]
