Brief Rebuke Against The Spiraling Ghuluww In an Issue Related to Disease and Medical Treatment

In The Name of Allaah, The Most Merciful, The Bestower of Mercy.
Reminder to Every Opinionated Person Who labels Some Trustworthy and Qualified Scientists As Conspiracy Theorists When They Identify Flaws, Critically Question, Analyse And Demand Transparency In The Worldly Sciences
Allaah [The Most High] said: [يَا أَيُّهَا الَّذِينَ آمَنُوا اجْتَنِبُوا كَثِيرًا مِنْ الظَّنِّ إِنَّ بَعْضَ الظَّنِّ إِثْمٌ – O you who believe! Avoid much suspicions, indeed some suspicions are sins]. [Surah Al-Hujuraat. Aayah 12]
Imaam As-Sa’di [may Allaah have mercy upon him] said: Allaah [The Most High] forbids much evil suspicion towards the believers, because some suspicions are tantamount to sin, such as the suspicion that is devoid of reality and indications that point to the validity of something, and the suspicion that is accompanied by much forbidden speech and deeds, because indeed the settlement of evil suspicion in the heart does not usually stop at that; rather it does not cease until the person utters and does that which is not permissible. (1)
Imaam Muhammad Ibn Saaleh Al-Uthaymeen [may Allaah have mercy upon him] said, “Not every suspicion is a sin and there is no harm regarding the suspicion that is based on clear indications regarding the validity of an affair. As for mere assumption, it is not permissible. For example, if a man – who is known to be upright – is seen with a woman by another man, then it is not permissible to accuse him that the woman he is seen with is a stranger [who he should not be with], because this is the type of suspicion that is tantamount to sin. But if this suspicion is based on a reason found in the Islamic legislation, then there is no harm to harbour such suspicion”. (2)
An Affair Regarding The Liars Whose Contradictions, Deceitful Behaviour And Plots Are Very Clear, But They Utilize The Media to Discredit Those Who Expose Them
Imaam Ibnul Qayyim [may Allaah have mercy upon him] said, “The fact that a statement regarding something is lies and falsehood is sometimes known based on the statement in and of itself, its contradictions, perplexity and the manifestation of those clear indications which shows that it is lies. Lies may manifest due to what it is in reality, what is apparent and what is being concealed. It is sometimes known due to the situation of the utterer of the lie, for indeed the one who is known for lying, wickedness and deception, his statements do not show anything else except a state of conformity with his deeds. He does not utter a statement or perform an action similar to that of a pious and truthful person – the one innocent of every evil, deception, lie and wicked behaviour; rather the heart, intention, statements and deeds of the truthful one have the same image; and the heart, statements, deeds and intentions of the liar have the same image”. (3)
An Affair Regarding Evil doers Whose Crimes And Dubious Dealings Are Well Known And Documented, But They Utilize The Media to Attack And Discredit Those Who Expose Them
Ameerul Mu’mineen Umar Ibn Al-Khattaab [may Allaah be pleased with him] said, “People were (sometimes) judged by the revealing of a Divine Inspiration during the lifetime of Allah’s Apostle but now there is no longer any more (new revelation). Now we judge you by the deeds you practice publicly, so we will trust and favour the one who does good deeds in front of us, and we will not call him to account about what he is really doing in secret, for Allah will judge him for that; but we will not trust or believe the one who presents to us wih an evil deed even if he claims that his intentions were good”. (4)
A Reminder to The Naive And Muqallidoon of The Scientists- Those Who Do Not Question Anything, But Also Desire That None Else Should Question!
Doctor must fear Allaah with regards to those affairs about which one is consulted, especially that which is related to the rights of the people- such as when a sick person approaches him for a sick note or when in need of a medical note to prove that he is fit for employment, or when consulted regarding a particular type of medication, or whether the state of health of an individual (woman) allows her to utilize contraception in order not to get pregnant, or whether her state of health warrants the removal of her ovaries. It has been reported in a hadeeth by Abu Hurairah [may Allaah be pleased with him] who said that the Messenger [peace and blessings of Allaah be upon him] said: [الْمُسْتَشَارُ مُؤْتَمَنٌ – The consultee is in a position of trust] [Saheeh Sunan Abu Dawud 5128]’
Few Reminders From The Above Hadeeth:
[الْمُسْتَشَارُ مُؤْتَمَنٌ – The consultee is in a position of trust]. [المستشار -The Consultee] is the one whose opinion is sought after regarding an affair of Maslahah (i.e. an affair that will bring about benefit and repel harm). He is in a position of trust with regards to what he is asked and it is not permissible for him to deceive the one who consults him, by concealing the affair that would bring about benefit. [See Hadeeth Number 5062′ Vol 4’ page 259′ in Mirqaat Al-Mafaateeh Sharh Mishkaat Al-Masaabeeh]
This hadeeth is an evidence, showing that the consultee has to (advise) with the course of action and opinion -in relation to the consultation – that which he would do for himself. And it is not permissible that he directs his Muslim brother to something he would not be pleased with for himself. The Muslim doctor should not make the patient a means to experimenting the effectiveness of a medication, especially if he fears that there would be great side effects. That is because this experimentation would negate the honour Allaah has bestowed on the children of Aadam. Allaah [The Most High] said: [وَلَقَدۡ كَرَّمۡنَا بَنِىٓ ءَادَمَ وَحَمَلۡنَـٰهُمۡ فِى ٱلۡبَرِّ وَٱلۡبَحۡرِ وَرَزَقۡنَـٰهُم مِّنَ ٱلطَّيِّبَـٰتِ وَفَضَّلۡنَـٰهُمۡ عَلَىٰ ڪَثِيرٍ۬ مِّمَّنۡ خَلَقۡنَا تَفۡضِيلاً۬ – And indeed We have honoured the Children of Adam, and We have carried them on land and sea, and have provided them with At-Taiyibat(lawful good things), and have preferred them above many of those whom We have created with a marked preference]. [Surah Al-Is’raa Aayah 70]
This deed [i.e. using the patient as a means to experimenting the effectiveness of a medication] negates the command [given to person to] safeguard the blood of a Muslim. The Prophet [peace and blessings of Allaah be upon him] said: A Muslim is the brother of another Muslim, so he should not oppress him, nor should he hand him over to an oppressor. Whoever fulfilled the needs of his brother, Allaah will fulfil his needs; whoever brought his [Muslim] brother out of discomfort, Allaah will bring him out of a discomfort from the discomforts of the Day of Resurrection, and whoever screened a Muslim, Allaah will screen him on the Day of Resurrection. [Bukhaari Hadeeth Number 2442]
If the Muslim doctor is certain that the harm [or side effects] that will result from the medication is lesser than the harm caused by the continuation of the illness, then it is permissible to give the medication based on choosing the lesser harm between two.
The Muslim doctor should be careful of what is transmitted in the medical journals (or textbooks) and he should not accept everything transmitted in them without ascertaining its correctness, for indeed knowledge is established either through a trustworthy transmission or an unquestionable view point. The affairs of medicine attributed to the Prophet must be verified as to whether their chains of transmission are authentic, and the affairs of medicine that are established by way of opinions [i.e. through study and research etc] should be examined to find out whether they are [sound, unsound, or whether they contain flaws, sin, offence etc]. He should not be an easy and legitimate prey whom the enemies of Allaah use as a path to transmit that which opposes the Religion of Islaam and causes harm to the Muslims; rather he should know that everything that comes to him regarding modern medicine has to be subjected to research and has to be ascertained. (4.1)
Therefore, how can people suggest that those in the West who exercise their right not to be vaccinated deserve to face strict restrictions in their daily lives?! This suggestion of some opinionated and aggressive pro-vaccine advocates is very worrying indeed, because it is as if those who hold a different view to theirs are to be pursued like terrorists. You find some Global Social Media platforms seeking to silence some scientists who produce credible proof in opposition to the views of some of the opinionated pro-vaccine advocates, whilst also pitting citizen against citizen, the vaccinated against the unvaccinated, and sowing the seeds of distrust and splitting between friends and families. This is one of the evil consequences of the fearmongering of some of the opinionated pro-vaccine advocates and contagionists. However, one is also not to follow the path of those who take the law into their own hands when objecting to the extreme measures of the opinionated pro-vaccine advocates. Question to Imaam Abdul Azeez Bin Baaz [may Allaah have mercy upon him]: “Is enjoining Good and Forbidding Evil by the hand an obligation on all Muslims, or is it limited to those in authority and their deputies?” Answer: “Stopping wrong is obligated on all Muslims according to their ability, because the Messenger [sallal laahu alayhi wasallam] said, ‘Anyone of you who sees evil, let them stop it with their hand; if he cannot, then with their tongue; and if they cannot, then with his heart, and that is the weakest of Imaan’. [Muslim, Abu Dawood, Tirmidhi & others] However, stopping evil by the hand must be based on ability and should not result in greater corruption or evil. A man has the right to rectify matters with his hand in his home [i.e. based on what the law of the land allows him]; a manager has the authority to make changes with the hand within the organization they are responsible for, in accordance with the instructions that were given to them [i.e. the authority given to them by the state authorities]; otherwise, people should not change with their hand anything they are not authorized to change. If they do make changes in matters that they have no authority over, this will result in more evil and great corruption between them and the people and between the people and the state. In this case they should stop evil with their tongue (by speaking out). They may say, ‘O Fulaan! Fear Allaah! This is not permissible; this is Haraam, or This is obligated on you,’ and clarify it with evidence from Sharee’ah. [NB: In the UK, objecting to certain behaviour can be viewed as harassment or verbal abuse, therefore a Muslim should be aware of what the law allows him before he says or does anything whilst living in the West]. As for changing matters with the hand, this should be done where one has authority, such as one’s home [i.e. within what the law allows], with those under one’s responsibility, or those authorized by the ruler, such as organizations given permission and authority to enjoin Good. They should make changes in accordance with the authority they have been given- in the way prescribed by the Sharee’ah, without exceeding their jurisdiction. The same applies to the governor of a city; he should make changes with his hand, in accordance with the instructions he has”. (5)
Therefore, we are not from those who slander Muslim or non-Muslim scientists with the term ‘Conspiracy Theorist’ just because they are brave enough to critically question the basis, validity, findings or treatment related to medical issues. Also, neither are we from those who join protests nor those who take the law into their own hands by sending suspicious packages to vaccine plants, nor from those who hold that the opinions of scientists in their countries are an unquestionable truth in every subject matter.
