Transgress or Allow Transgression and Say, “Allaah Commanded Us to Do It” or “The Act Is Lawful, But Awful”

In The Name of Allaah, The Most Merciful, The Bestower of Mercy.
Those Transgress or Allow Transgression and Then Say, “Allaah Commanded Us to Do It” or “The Act Is Lawful, But Awful”- [Statements of Those Who Jest With Allah’s Revelation and Those Who Appoint Themselves As The Ones Who Have a Right to Decide What Should Be Allowed or Disallowed In Different Circumstances With Regards to Halaal and Haraam]
Those Who Commit Evil and Say, “Allaah Commanded Us to Commit The Act”
Allaah [The Exalted] said:
وَإِذَا فَعَلُواْ فَـٰحِشَةً۬ قَالُواْ وَجَدۡنَا عَلَيۡہَآ ءَابَآءَنَا وَٱللَّهُ أَمَرَنَا بِہَاۗ قُلۡ إِنَّ ٱللَّهَ لَا يَأۡمُرُ بِٱلۡفَحۡشَآءِۖ أَتَقُولُونَ عَلَى ٱللَّهِ مَا لَا تَعۡلَمُونَ
قُلۡ أَمَرَ رَبِّى بِٱلۡقِسۡطِۖ وَأَقِيمُواْ وُجُوهَكُمۡ عِندَ ڪُلِّ مَسۡجِدٍ۬ وَٱدۡعُوهُ مُخۡلِصِينَ لَهُ ٱلدِّينَۚ كَمَا بَدَأَكُمۡ تَعُودُونَ
فَرِيقًا هَدَىٰ وَفَرِيقًا حَقَّ عَلَيۡہِمُ ٱلضَّلَـٰلَةُۗ إِنَّهُمُ ٱتَّخَذُواْ ٱلشَّيَـٰطِينَ أَوۡلِيَآءَ مِن دُونِ ٱللَّهِ وَيَحۡسَبُونَ أَنَّہُم مُّهۡتَدُونَ
And when they commit a Fahisha, they say: “We found our fathers doing it, and Allah has commanded us of it.” Say: “Nay, Allah never commands of Fahisha. Do you say of Allah what you know not?] Say (O Muhammad): My Lord has commanded justice and (said) that you should face Him only (i.e. worship none but Allah and face the Qiblah, i.e. the Ka’bah at Makkah during prayers) in each and every place of worship, in prayers (and not to face other false deities and idols), and invoke Him only making your religion sincere to Him by not joining in worship any partner to Him and with the intention that you are doing your deeds for Allah’s sake only. As He brought you (into being) in the beginning, so shall you be brought into being (on the Day of Resurrection) [in two groups, one as a blessed one (believers), and the other as a wretched one (disbelievers)]. A group He has guided, and a group deserved to be in error; (because) surely they took the Shayatin (devils) as Auliya’ (protectors and helpers) instead of Allah, and consider that they are guided. [Surah Al-A’raf. Aayaat 28-30]
Allah stated, whilst making known the repugnant state of the Mushrikoon who commit sins and attributed that to something Allaah commanded them. [وَإِذَا فَعَلُواْ فَـٰحِشَةً۬ – And when they commit a Fahisha]- Meaning, everything that is regarded to be indecent and repugnant, including when they performed Tawaaf around the Kabah whilst naked. [قَالُواْ وَجَدۡنَا عَلَيۡہَآ ءَابَآءَنَا – they say: “We found our fathers doing it]: they told the truth regarding this affair (i.e. that they found their forefathers upon those repugnant deeds); [وَٱللَّهُ أَمَرَنَا بِہَاۗ – and Allah has commanded us of it], but they lied regarding this other affair and thus Allaah rebutted them for attributing this to Him, saying: [قُلۡ إِنَّ ٱللَّهَ لَا يَأۡمُرُ بِٱلۡفَحۡشَآءِۖ – Say: “Nay, Allah never commands of Fahisha]- Meaning, it does not befit Allaah’s perfection and wisdom to command His servants to commit immorality, whether it is this act committed by the Mushrikoon or other than it. [أَتَقُولُونَ عَلَى ٱللَّهِ مَا لَا تَعۡلَمُونَ – Do you say of Allah what you know not?]- Meaning, what fabrication can be more severe than this?! Then Allaah stated: [قُلۡ أَمَرَ رَبِّى بِٱلۡقِسۡطِۖ – ?] Say (O Muhammad): My Lord has commanded justice] – Meaning, in acts of worship and mutual dealings, and not wrongdoing and injustice. (1)
Imaam Ash-Shanqeetee [may Allaah have mercy upon him] stated: Allaah mentions in this noble verse that when the unbelievers committed evil, they sought to establish it to be truth and something correct by saying that they found their forefathers doing the same, and that they have not done so, except because it is guidance and something correct. Allaah clarified in another verse of the Qur’aan that this is the state of affairs of all the nations (i.e. those who obstinately disbelieved in the Messengers), saying:
[وَكَذَٲلِكَ مَآ أَرۡسَلۡنَا مِن قَبۡلِكَ فِى قَرۡيَةٍ۬ مِّن نَّذِيرٍ إِلَّا قَالَ مُتۡرَفُوهَآ إِنَّا وَجَدۡنَآ ءَابَآءَنَا عَلَىٰٓ أُمَّةٍ۬ وَإِنَّا عَلَىٰٓ ءَاثَـٰرِهِم مُّقۡتَدُونَ – And similarly, We sent not a warner before you (O Muhammad) to any town (people) but the luxurious ones among them said: “We found our fathers following a certain way and religion, and we will indeed follow their footsteps.”] [Surah Az-Zukhruf. Aayah 23]
Allaah rebutted them for this blind following in many verses, such as His statement:
[أَوَلَوۡ كَانَ ءَابَآؤُهُمۡ لَا يَعۡقِلُونَ شَيۡـًٔ۬ا وَلَا يَهۡتَدُونَ – Even though their fathers did not understand anything nor were they guided? (Al-Baqarah 170)]
[أَوَلَوۡ كَانَ ءَابَآؤُهُمۡ لَا يَعۡلَمُونَ شَيۡـًٔ۬ا وَلَا يَہۡتَدُونَ – even though their fathers had no knowledge whatsoever and no guidance. (Al-Maa’idah 104)]
[قَـٰلَ أَوَلَوۡ جِئۡتُكُم بِأَهۡدَىٰ مِمَّا وَجَدتُّمۡ عَلَيۡهِ ءَابَآءَكُمۡۖ – Even if I bring you better guidance than that which you found your fathers following? (Az-Zukhruf 24)]
إِنَّہُمۡ أَلۡفَوۡاْ ءَابَآءَهُمۡ ضَآلِّينَ
فَهُمۡ عَلَىٰٓ ءَاثَـٰرِهِمۡ يُہۡرَعُونَ
Verily, they found their fathers on the wrong path; so they hastened [to follow] in their footsteps. [As-Saffaat. Aayah 69-70] (2)
This was the behaviour of the pagan Arabs! However, at present we find something amazing amongst some Christian leaders when making an agreement – in the name of unity – to allow something that is prohibited in the pure teachings of all the Prophets. One says that a forbidden marriage contract should be made lawful in their religion, the second one says that he will seek god’s blessing for those engaged in such a forbidden contract and the third one says he will not get involved in seeking blessings for those engaged in the sin, but he is happy that some of his brethren in faith will be allowed to ‘Offer God’s Blessings’ for those seeking after the forbidden marriage contract!!! When one witnesses the likes of this corruption, it reminds us of what Allaah [The Exalted] stated about the corrupt scholars amongst the people of the Scripture. Allaah said: [ ٱتَّخَذُوٓاْ أَحۡبَارَهُمۡ وَرُهۡبَـٰنَهُمۡ أَرۡبَابً۬ا مِّن دُونِ ٱللَّ – They (Jews and Christians) took their rabbis and their monks to be their lords besides Allaah]. Al-Allaamah Saaleh Al-Fawzaan [may Allaah preserve him] stated: They (i.e. the corrupt rabbis and the monks) made lawful for them that which is unlawful and they obeyed them, and they made unlawful for them that which is lawful and they obeyed them. So they became lords besides Allaah, because to declare something lawful or unlawful is the right of Allaah. It is not allowed for anyone to declare something lawful or unlawful based on his desires, self-interest, to appease people and being in conformity with them. At present there are those who play tricks with the Sharee’ah. They make lawful that which is unlawful in order to be in conformity with the people, and to please the people. And with these assumptions of theirs, they solicit trickery and make concessions, (see footnote a) or lie against Allaah; that Allaah has declared this lawful and that unlawful for the benefit of such and such (individual). These ones are the sinful scholars. And the faasiq (the sinner) is the one who deviates from obedience to Allaah.
The Shaikh also stated, “At present when someone desires something he would say, “Such and such a person has given a verdict on this (affair)” without considering whether it has a basis in the Book and the Sunnah. And you say to him, “This verdict is wrong”, he says, “It has nothing to do with me” as long as the verdict was given by such and such (person)”. And if the verdict is not in agreement with his desires, he says, “This verdict is not correct or it is a harsh one”. They gather lies and the mistakes of the scholars in a book and present it to the people, and spread it amongst the people with their assumptions, saying, “The Religion of Islam is easy. It does not make things uneasy for the people”. And when it is said to them, “Examine it (i.e. these verdicts) under the Book and Sunnah”, they say, “These are statements of the scholars”. Is the scholar greater than the Book and the Sunnah? Are his statements not to be examined under the Book and the Sunnah!? This is how the people of desires act, and Allaah’s Refuge is sought. They are those who ‘took their rabbis and monks to be lords besides Allaah’. (see footnote b) (3)
The Act Is Repugnant, Vile and Awful, But Lawful
This is what we hear some people saying when the Qur’aan was burnt by the idiotic fame seeking Danish-Swedish Far-right Demagogue (Rasmus Paludan). They said, “The act if vile, repugnant and awful, but lawful”. If those who utter this statement are Christians, then indeed it has already been established that those Christians who deviated from the path of the Messiah are well known for deciding halaal and haraam based on desires, tricks and innovations in religious affairs; but if those who utter these statement call themselves secularists, then it would be appropriate for them to clearly say that they do not recognise the laws of the Creator and that they have given themselves the right to decide halaal and haraam without guidance from their Creator. Indeed, Allaah alone has the right to pass a judgement on halaal or haraam. Allaah [The Exalted] said:
[وَلَا تَقُولُوا لِمَا تَصِفُ أَلْسِنَتُكُمُ الْكَذِبَ هَٰذَا حَلَالٌ وَهَٰذَا حَرَامٌ لِّتَفْتَرُوا عَلَى اللَّهِ الْكَذِبَ ۚ إِنَّ الَّذِينَ يَفْتَرُونَ عَلَى اللَّهِ الْكَذِبَ لَا يُفْلِحُونَ – And say not concerning that which your tongues put forth falsely: “This is lawful and this is forbidden,” so as to invent lies against Allah. Verily, those who invent lies against Allah will never prosper]. [Surah An-Nahl. Aayah 116]
The Musrikoon passed judgements on halaal and haraam based on false beliefs and desires. Allaah [The Exalted] said:
إِنَّمَا النَّسِيءُ زِيَادَةٌ فِي الْكُفْرِ ۖ يُضَلُّ بِهِ الَّذِينَ كَفَرُوا يُحِلُّونَهُ عَامًا وَيُحَرِّمُونَهُ عَامًا لِّيُوَاطِئُوا عِدَّةَ مَا حَرَّمَ اللَّهُ فَيُحِلُّوا مَا حَرَّمَ اللَّهُ ۚ زُيِّنَ لَهُمْ سُوءُ أَعْمَالِهِمْ ۗ وَاللَّهُ لَا يَهْدِي الْقَوْمَ الْكَافِرِينَ
The postponing (of a Sacred Month) is indeed an addition to disbelief: thereby the disbelievers are led astray, for they make it lawful one year and forbid it another year in order to adjust the number of months forbidden by Allah, and make such forbidden ones lawful. The evil of their deeds seems pleasing to them. And Allah guides not the people, who disbelieve. [Surah At-Tawbah. Aayah 37]
[قُلْ أَرَأَيْتُم مَّا أَنزَلَ اللَّهُ لَكُم مِّن رِّزْقٍ فَجَعَلْتُم مِّنْهُ حَرَامًا وَحَلَالًا قُلْ آللَّهُ أَذِنَ لَكُمْ ۖ أَمْ عَلَى اللَّهِ تَفْتَرُونَ – Say (O Muhammad to these polytheists): “Tell me, what provision Allah has sent down to you! And you have made of it lawful and unlawful.” Say (O Muhammad ): “Has Allah permitted you (to do so), or do you invent a lie against Allah?”] [Surah Yunus. Aayah 59]
وَڪَذَٲلِكَ زَيَّنَ لِڪَثِيرٍ۬ مِّنَ ٱلۡمُشۡرِڪِينَ قَتۡلَ أَوۡلَـٰدِهِمۡ شُرَڪَآؤُهُمۡ لِيُرۡدُوهُمۡ وَلِيَلۡبِسُواْ عَلَيۡهِمۡ دِينَهُمۡۖ وَلَوۡ شَآءَ ٱللَّهُ مَا فَعَلُوهُۖ فَذَرۡهُمۡ وَمَا يَفۡتَرُونَ
And so to many of the Mushrikun (polytheists) their (Allah’s so-called) “partners” have made fair-seeming the killing of their children, in order to lead them to their own destruction and cause confusion in their religion. And if Allah had willed they would not have done so. So leave them alone with their fabrications. [Surah Al-An’aam. Aayah 137]
وَقَالُواْ هَـٰذِهِۦۤ أَنۡعَـٰمٌ۬ وَحَرۡثٌ حِجۡرٌ۬ لَّا يَطۡعَمُهَآ إِلَّا مَن نَّشَآءُ بِزَعۡمِهِمۡ وَأَنۡعَـٰمٌ حُرِّمَتۡ ظُهُورُهَا وَأَنۡعَـٰمٌ۬ لَّا يَذۡكُرُونَ ٱسۡمَ ٱللَّهِ عَلَيۡهَا ٱفۡتِرَآءً عَلَيۡهِۚ سَيَجۡزِيهِم بِمَا ڪَانُواْ يَفۡتَرُونَ
وَقَالُواْ مَا فِى بُطُونِ هَـٰذِهِ ٱلۡأَنۡعَـٰمِ خَالِصَةٌ۬ لِّذُڪُورِنَا وَمُحَرَّمٌ عَلَىٰٓ أَزۡوَٲجِنَاۖ وَإِن يَكُن مَّيۡتَةً۬ فَهُمۡ فِيهِ شُرَڪَآءُۚ سَيَجۡزِيهِمۡ وَصۡفَهُمۡۚ إِنَّهُ ۥ حَڪِيمٌ عَلِيمٌ۬
قَدۡ خَسِرَ ٱلَّذِينَ قَتَلُوٓاْ أَوۡلَـٰدَهُمۡ سَفَهَۢا بِغَيۡرِ عِلۡمٍ۬ وَحَرَّمُواْ مَا رَزَقَهُمُ ٱللَّهُ ٱفۡتِرَآءً عَلَى ٱللَّهِۚ قَدۡ ضَلُّواْ وَمَا ڪَانُواْ مُهۡتَدِينَ
And according to their pretending, they say that such and such cattle and crops are forbidden, and none should eat of them except those whom we allow. And (they say) there are cattle forbidden to be used for burden or any other work, and cattle on which (at slaughtering) the Name of Allah is not pronounced; lying against Him (Allah). He will recompense them for what they used to fabricate. And they say: “What is in the bellies of such and such cattle (milk or foetus) is for our males alone, and forbidden to our females (girls and women), but if it is born dead, then all have shares therein.” He will punish them for their attribution (of such false orders to Allah). Verily, He is All-Wise, All-Knower. Indeed lost are they who have killed their children, from folly, without knowledge, and have forbidden that which Allah has provided for them, inventing a lie against Allah. They have indeed gone astray and were not guided. [Surah Al-An’aam. Aayaat 138-140]
Allaah said:
فَكُلُواْ مِمَّا رَزَقَڪُمُ ٱللَّهُ حَلَـٰلاً۬ طَيِّبً۬ا وَٱشۡڪُرُواْ نِعۡمَتَ ٱللَّهِ إِن كُنتُمۡ إِيَّاهُ تَعۡبُدُونَ
إِنَّمَا حَرَّمَ عَلَيۡڪُمُ ٱلۡمَيۡتَةَ وَٱلدَّمَ وَلَحۡمَ ٱلۡخِنزِيرِ وَمَآ أُهِلَّ لِغَيۡرِ ٱللَّهِ بِهِۦۖ فَمَنِ ٱضۡطُرَّ غَيۡرَ بَاغٍ۬ وَلَا عَادٍ۬ فَإِنَّ ٱللَّهَ غَفُورٌ۬ رَّحِيمٌ۬
وَلَا تَقُولُواْ لِمَا تَصِفُ أَلۡسِنَتُڪُمُ ٱلۡكَذِبَ هَـٰذَا حَلَـٰلٌ۬ وَهَـٰذَا حَرَامٌ۬ لِّتَفۡتَرُواْ عَلَى ٱللَّهِ ٱلۡكَذِبَۚ إِنَّ ٱلَّذِينَ يَفۡتَرُونَ عَلَى ٱللَّهِ ٱلۡكَذِبَ لَا يُفۡلِحُونَ
مَتَـٰعٌ۬ قَلِيلٌ۬ وَلَهُمۡ عَذَابٌ أَلِيمٌ۬
So eat of the lawful and good food which Allah has provided for you. And be grateful for the Graces of Allah, if it is He Whom you worship. He has forbidden you only Al-Maytatah (meat of a dead animal), blood, the flesh of swine, and any animal which is slaughtered as a sacrifice for others than Allah (or has been slaughtered for idols etc. or on which Allah’s Name has not been mentioned while slaughtering). But if one is forced by necessity, without wilful disobedience, and not transgressing, then, Allah is Oft-Forgiving, Most Merciful. And say not concerning that which your tongues put forth falsely: “This is lawful and this is forbidden,” so as to invent lies against Allah. Verily, those who invent lies against Allah will never prosper. A passing brief enjoyment (will be theirs), but they will have a painful torment. [Surah An-Nahl. Aayaat 114-117]
Al-Allaamah Rabee Bin Haadi Al-Madkhali [may Allaah preserve him] said: This was an address to the Arabs who instituted things like Bahirah or a Sa’ibah, and due to this Allaah declared this affair of theirs a lie, determined the unlawful things in relation to that which they stated, made it known that what they declared unlawful or lawful is tantamount to lies invented against Allaah, that the liars will not be successful, their enjoyment through lies and slanders is a brief enjoyment and an eternal punishment awaits them – a painful punishment. (4)
Allaah Alone Has a Right to Pass Judgement On That Which Is Unlawful, But Becomes Allowed In Some Specific Circumstances
Allaah [The Exalted] said:
فَكُلُواْ مِمَّا ذُكِرَ ٱسۡمُ ٱللَّهِ عَلَيۡهِ إِن كُنتُم بِـَٔايَـٰتِهِۦ مُؤۡمِنِينَ
وَمَا لَكُمۡ أَلَّا تَأۡڪُلُواْ مِمَّا ذُكِرَ ٱسۡمُ ٱللَّهِ عَلَيۡهِ وَقَدۡ فَصَّلَ لَكُم مَّا حَرَّمَ عَلَيۡكُمۡ إِلَّا مَا ٱضۡطُرِرۡتُمۡ إِلَيۡهِۗ وَإِنَّ كَثِيرً۬ا لَّيُضِلُّونَ بِأَهۡوَآٮِٕهِم بِغَيۡرِ عِلۡمٍۗ إِنَّ رَبَّكَ هُوَ أَعۡلَمُ بِٱلۡمُعۡتَدِينَ
So eat of that (meat) on which Allah’s Name has been pronounced (while slaughtering the animal), if you are believers in His Ayat (proofs, evidences, verses, lessons, signs, revelations, etc.). And why should you not eat of that (meat) on which Allah’s Name has been pronounced (at the time of slaughtering the animal), while He has explained to you in detail what is forbidden to you, except under compulsion of necessity? And surely many do lead (mankind) astray by their own desires through lack of knowledge. Certainly your Lord knows best the transgressors. [Surah Al-An’aam. Aayah 118-119]
Allaah [The Exalted] said:
مَن ڪَفَرَ بِٱللَّهِ مِنۢ بَعۡدِ إِيمَـٰنِهِۦۤ إِلَّا مَنۡ أُڪۡرِهَ وَقَلۡبُهُ ۥ مُطۡمَٮِٕنُّۢ بِٱلۡإِيمَـٰنِ وَلَـٰكِن مَّن شَرَحَ بِٱلۡكُفۡرِ صَدۡرً۬ا فَعَلَيۡهِمۡ غَضَبٌ۬ مِّنَ ٱللَّهِ وَلَهُمۡ عَذَابٌ عَظِيمٌ۬
ذَٲلِكَ بِأَنَّهُمُ ٱسۡتَحَبُّواْ ٱلۡحَيَوٰةَ ٱلدُّنۡيَا عَلَى ٱلۡأَخِرَةِ وَأَنَّ ٱللَّهَ لَا يَهۡدِى ٱلۡقَوۡمَ ٱلۡڪَـٰفِرِينَ
أُوْلَـٰٓٮِٕكَ ٱلَّذِينَ طَبَعَ ٱللَّهُ عَلَىٰ قُلُوبِهِمۡ وَسَمۡعِهِمۡ وَأَبۡصَـٰرِهِمۡۖ وَأُوْلَـٰٓٮِٕكَ هُمُ ٱلۡغَـٰفِلُونَ
لَا جَرَمَ أَنَّهُمۡ فِى ٱلۡأَخِرَةِ هُمُ ٱلۡخَـٰسِرُونَ
ثُمَّ إِنَّ رَبَّكَ لِلَّذِينَ هَاجَرُواْ مِنۢ بَعۡدِ مَا فُتِنُواْ ثُمَّ جَـٰهَدُواْ وَصَبَرُوٓاْ إِنَّ رَبَّكَ مِنۢ بَعۡدِهَا لَغَفُورٌ۬ رَّحِيمٌ۬
Whoever disbelieves in Allah after his belief, except for one who is forced [to renounce his religion] while his heart is secure in faith; but those who [willingly] open their breasts to disbelief, upon them is wrath from Allah, and for them is a great punishment. That is because they loved and preferred the life of this world over that of the Hereafter. And Allah guides not the people who disbelieve. They are those upon whose hearts, hearing (ears) and sight (eyes) Allah has set a seal. And they are the heedless! No doubt, in the Hereafter, they will be the losers. Then, verily! Your Lord for those who emigrated after they had been put to trials and thereafter strove hard and fought (for the Cause of Allah) and were patient, verily, your Lord afterward is, Oft-Forgiving, Most Merciful. [Surah An-Nahl. Aayah 106]
“Whoever disbelieves in Allah after his belief, except for one who is forced [to renounce his religion] while his heart is secure in faith..”– Imaam Ibn Katheer [may Allaah have mercy upon him] said, “This is an exception for the one who utters disbelief with his tongue and agrees with the polytheists in statement out of being forced because of the beating and harm he suffered, but his heart rejects what he utters and he is secure in his belief in Allaah and His Messenger”. Imaam Ibnul Qayyim [may Allaah have mercy upon him] stated: It has been stated that the reason behind Iblees being distanced [from the mercy of Allaah] is because of false interpretation, for indeed he made an analogy with the text and gave precedence to the analogy over the text. He made a false interpretation about himself and that [his so called] rational analogy takes precedence over the command to prostrate. [Allaah informed us that Iblees said]: [أنا خير منه – I am better than him [i.e. Aadam], and that a virtuous one cannot humble himself to one who has been given virtue over him; therefore he quickly said [as Allaah informed us that Iblees said]: [خلقتني من نار وخلقته من طين – You created me from fire, and him you created from clay].
Therefore, he thought that this rational analogy that resembles truth- even though it is false – will benefit him in his false interpretation. So, that which happened him happened and he became the leader of everyone- until the day of judgement- who makes a false interpretation of the texts of the revelation. How many a person in this world are followers of this cursed leader! And if you contemplate on the majority of those doubts that are made to resemble the truth by the false interpreters of the texts and seeking to nullify them, you will find that it is similar to the doubts of Iblees which he seeks to portray as truth.
So, a person says: If the intellect and the text oppose each other, then give precedence to the intellect. This is where this principle is derived from and he [i.e. the proponent of this affair] use it as a fundamental principle through which he rejects those texts of the revelation which he claims are in opposition to the intellect, just as his leader Iblees claimed that a [so called] rational proof opposed the command to make sujood. This doubt came to him due to pride which prevented him from submitting to the clear texts of the revelation. Likewise, you find every false disputer against the texts of the revelation does so due to pride. Allaah [The Exalted] said:
إِنَّ الَّذِينَ يُجَادِلُونَ فِي آيَاتِ اللَّهِ بِغَيْرِ سُلْطَانٍ أَتَاهُمْ ۙ إِن فِي صُدُورِهِمْ إِلَّا كِبْرٌ مَّا هُم بِبَالِغِيهِ ۚ فَاسْتَعِذْ بِاللَّهِ ۖ إِنَّهُ هُوَ السَّمِيعُ الْبَصِيرُ
Verily, those who dispute about the Ayat (proofs, evidences, verses, lessons, signs, revelations, etc.) of Allah, without any authority having come to them, there is nothing else in their breasts except pride [to accept you (Muhammad ) as a Messenger of Allah and to obey you]. They will never have it (i.e. Prophethood which Allah has bestowed upon you). So seek refuge in Allah (O Muhammad from the arrogants). Verily, it is He Who is the All-Hearer, the All-Seer. [Surah Ghaafir. Aayah 56] (6)
Shaikh Abu Iyaadh [may Allaah preserve him] stated: The wisdom of the Islamic Shariah: Cut off evils and harms to society from their very roots and enjoy the resulting freedom, ease and wholesome life. In contrast: the barbarity and backwardness of commercialising corrosive evils– usurious banking, alcohol, gambling–in order to profit from the masses through affairs in which their ruin and impoverishment lies–and then managing this commercialisation through legislation, policies, guidelines and so on to “limit the harms”. The result? Inescapable enslavement, bondage, disease and ruin of the masses for the enrichment of the few who peddle these vices. Where is the intellect?! (7)

The “Ahbaar” are the scholars, and the “Ruhbaan” are the general worshippers – and the habit of the people is to refer back to these two groups and take to their speech and opinions. Allaah, the Mighty and Majestic, rebuked the unbelievers because they took the Ahbaar and Ruhbaan (the scholars and worshippers) as Lords besides Allaah whereby they made them as legislators of Religious Law (i.e. the Revelation). They would make halaal for them that which Allaah had made haraam, so they would then consider it to be halaal. And they would make haraam for them that which Allaah had made halaal, so they would then consider it to be haraam. This however does not necessitate, in an absolute sense, exiting from Islaam, rather this point it requires further explanation. So sometimes the one who falls into this reaches the point whereby he exits Islaam, and this is when they take them as legislators of Religious Law (i.e. the Revelation). So they take their legislation and they give it precedence over an above that which Allaah has legislated in His Book, and that which the Messenger (sallallaahu ‘alaihi wassallam) legislated, and they believe that this legislation that is not from Allaah and His Messenger is equal to Allaah’s Legislation or an increase upon it.
However, if they seek verdicts (fatwas) from them and they issue fatwas making haraam what is halaal, or making halaal what is haraam. So they obey them in making haraam the halaal matters, and making halaal the haraam matters by way of acting upon those verdicts – and the people obey them whilst they know they are sinning and they affirm the fact that it is a sin, yet they still follow them but they know internally what is halaal is halaal and what is haraam is haraam.
