In The Name of Allah, The Most Merciful, The Bestower of Mercy.
Imam As-Sadi [may Allah have mercy upon him] said:
The Shari’ah established the permissibility of business dealings, renting, corporations (business partnerships), and the various forms of interpersonal exchanges between people that involve specific goods, debts, material benefits, and other things. Given that it covers a range of matters pertaining to welfare, necessities, needs, and luxuries, the perfect Shariah was revealed to regulate this type of mutual dealing and place it at the people’s disposal, in order to provide them with the opportunity to better their living conditions and acquire the sources of their livelihood. In these matters, the Shariah stipulated that both parties must consent, and contracts must be based on knowledge – knowledge of the contracting party, knowledge of the subject of the contract, and knowledge of the conditions that result from it. Additionally, it forbids anything that leads to harm and injustice, including any sort of gambling, usury, and price, sale, or item obfuscation. (footnote a)
Whoever contemplates the Shariah mutual dealings will see their firm connection to sound rectification of religious and worldly affairs, and will testify to Allah’s vast Perfect Mercy and Perfect Wisdom, because Allah permitted all good things for the people, such as (lawful) earnings, foods and drinks, and well-established ways of obtaining beneficial things. Al-Allaamah Ahmad Shaakir [may Allaah have mercy upon him] said, “Yes, until one knows what to take and what to abandon, what is lawful and what is unlawful so that they neither corrupt the commerce of the people with falsehood and lies nor enter them into usury from any angle while the buyer is unaware of that. Trade should be based on sound Islamic principles, so that both Muslims and non-Muslims are content with it- free from deception and swindling”. [Tahqeeq Sunan at-Tirmidhee 2/357]
